Terms and Conditions of Service: Department of Physical Education
Definitions
"DPE" or "Service Provider" means the Department of Physical Education.
"User" means any natural person or juristic person utilizing any services of DPE.
"Service" means and includes the use of products, software, and websites of DPE.
Terms of Service of DPE
1. General Provisions
1.1 DPE shall provide the Service to the User under the terms and conditions of service set forth in this document, hereinafter referred to as the "General Terms," and under any additional service agreements specified for any particular service, hereinafter referred to as the "Specific Terms."
1.2 The User may acknowledge the General Terms and Specific Terms through accessing and utilizing the Service of DPE.
1.3 The General Terms and Specific Terms, hereinafter collectively referred to as the "Terms," constitute the essential substance of DPE's service provision. The User has a duty to read these Terms thoroughly and understand them in detail, and they shall be legally binding between the User and DPE.
1.4 In the event of any conflict between the General Terms and the Specific Terms, the provisions of the Specific Terms shall prevail and apply to that specific service instead of the General Terms.
1.5 DPE reserves the right to amend, modify, or supplement the Terms at any time without prior written notice to the User.
2. Acceptance of the Terms
2.1 The User must acknowledge and accept the Terms; otherwise, the User shall not be permitted to use the Service.
2.2 The User may acknowledge and accept the Terms by:
(1) Signing to acknowledge and accept the Terms on the service application form provided by DPE.
(2) Using the Service of DPE. In this case, it shall be deemed that the User implicitly acknowledges and accepts the Terms from the moment the use of the Service commences onwards.
2.3 The User should save or retain a copy of the General Terms for their records and evidence.
3. Provision of Service by DPE
3.1 DPE may develop, modify, or improve the format and features of the Service to provide the best possible experience to the User, without prior notice to the User.
3.2 DPE may temporarily or permanently suspend or terminate the Service to any particular User without prior notice if such service provision affects other users or violates the law. DPE shall notify the User within 7 days after taking such action.
3.3 Upon suspension or termination of the Service under Clause 3.2, the User will no longer be able to access the Service, their account details, any files, or other contents contained within the User's account.
Note: In the event that DPE permanently suspends or terminates the Service, DPE reserves the right to delete all data contained within the User's account without prior notice to the User.
3.4 DPE may, at its sole discretion, establish a maximum limit on the volume of data that the User may send or receive through the Service, or the amount of storage space used for any service at any time, except where otherwise agreed upon in writing with DPE.
4. Use of Service by the User
4.1 The User shall provide accurate, truthful, and up-to-date information about themselves, such as identification details or contact information, as part of the registration process or for the continuous use of the Service.
4.2 The User shall use the Service solely for purposes permitted under the agreement made with DPE and in compliance with applicable laws, regulations, rules, and generally accepted practices.
4.3 The User shall not access or attempt to access any service by any means other than the channels provided by DPE, including the use of automated means (such as scripts), unless explicitly permitted in writing by DPE.
4.4 The User shall not engage in any activity that disrupts or interferes with DPE’s services, including the servers and networks connected to the Service.
4.5 The User shall not copy, duplicate, reproduce, sell, trade, or resell the Service for any purpose, unless explicitly permitted in writing by DPE.
4.6 The User shall be solely liable to any person for any damages arising out of their breach of the Terms.
5. Passwords and Account Security
5.1 The User is responsible for maintaining the confidentiality of the passwords associated with any account used to access the Service.
5.2 The User shall be solely responsible to DPE for all activities that occur under their account.
6. Privacy and Protection of User's Personal Data
6.1 DPE shall treat personal data and protect the privacy of the User in accordance with DPE’s Privacy Policy.
6.2 The User agrees to comply with DPE’s Privacy Policy.
7. Content in the Service
7.1 The User may receive, access, create, transmit, or display information, such as data files, written text, computer software, music, audio files or other sounds, photographs, videos, or other images, as part of or through the use of the Service, hereinafter referred to as the "Content."
7.2 The Content presented to the User may be protected by the intellectual property rights of the respective owner. The User has no right to modify, adapt, rent, lease, loan, sell, distribute, or create derivative works based on such Content, whether in whole or in part, unless explicitly authorized by the owner of that Content.
7.3 The User acknowledges that they may encounter content that is inappropriate, offensive, or objectionable, and uses the Service at their own risk.
7.4 DPE reserves the right to pre-screen, review, flag, filter, modify, refuse, or remove any inappropriate Content from the Service. DPE may provide explicit content filtering tools in compliance with relevant laws and government regulations.
7.5 DPE shall not be liable to any person for any loss or damage arising from Content not created by DPE. The person who originates such Content shall be solely responsible.
Note: If the User creates, transmits, or displays any Content within the Service, the User shall be solely responsible for any loss or damage caused by such Content to any person, including DPE.
8. Ownership and Intellectual Property Rights
8.1 DPE, or its licensors, holds all legal rights, titles, and interests, including any intellectual property rights contained within the Service created by DPE or its licensors, regardless of whether those rights are registered or not.
8.2 The User shall not disclose any information designated as confidential by DPE without the prior written consent of DPE.
8.3 The User shall not use DPE’s trade names, trademarks, service marks, logos, or domain names without the prior written consent of DPE.
